Disputes over Wills, Trust and other Fiduciary relationships

One of the principal aims of any lawyer has to be to advise their clients and to prepare documents in such a way as to minimise the risk of subsequent disputes.

However, there will inevitably be occasions when problems arise.

Typically, beneficiaries may discover that the aims of a Trust are not being achieved because of some fault in the drafting of the Trust documents; or they may take the view that one or more of the Trustees appointed is not performing properly or appropriately.

Dissappointed family members may believe that the Will of a recently deceased relative appears to have been made under duress or undue influence; or that the provisions of the Will fail to make adequate provision for a dependant.
